Legal and tax advice for the self-employed
Being self-employed or an independent professional means taking on every role at once: the one who produces, the one who sells, the one who invoices and the one who answers when something goes wrong. There is no corporate structure to put distance between you and the problems: you sign the contracts, you take on the debts and, in many cases, you answer with your own assets. That is why having a firm behind you is not a luxury, but a way of protecting your work.
At BBM Abogados we have been supporting professionals in Santander and Cantabria since 1990. We bring together legal and tax advice in a single team, so you don’t have to go from one door to another. You can tell us about your situation with no obligation or call us on 942 36 10 48.
Contracts, unpaid debts and taxation
Most of a self-employed person’s disputes stem from the same thing: an order that was never properly defined. A clear contract, setting out the scope, the deadlines, the price and the consequences of breach in writing, avoids a good part of those problems and is your best evidence if the client fails to comply.
When the problem is that you aren’t getting paid, we act. We recover your unpaid invoices first amicably and, if there is no response, through the courts, bearing in mind that since 2025 it is compulsory to attempt a prior agreement (MASC) before suing in civil matters. And on the tax side, we handle your income tax, your VAT and the rest of your obligations through our tax advice, optimising your tax position and answering on your behalf to any demand from the tax authorities.
When debts exceed what you can pay
Going it alone carries risks, and sometimes things don’t work out. If the debts have grown beyond what you can take on, you are not condemned to carry them for the rest of your life. The Second Chance Act allows self-employed people acting in good faith to have their debts written off and start again, including part of the public debt owed to the tax authorities and Social Security.
We study whether you meet the requirements and handle the whole procedure with you, with the utmost discretion. Find out how the Second Chance Act works or, better still, tell us about your case and we’ll study it with no obligation.
