Carriage contracts, unpaid carriage charges and damage
The day-to-day generates many legal fronts. The most common is arrears: shippers who do not pay on time and put your cash flow at risk. We recover unpaid carriage charges through the most effective route, usually the order for payment procedure, and if necessary we go to the courts to recover the full debt.
We also review and draft your carriage contracts so that the terms are clear from the start: price, deadlines, liability and penalties. A good contract avoids most disputes.
When the goods suffer loss or damage, the carrier’s liability regime comes into play, which differs depending on whether the transport is national (Land Carriage Contract Act and LOTT) or international (CMR convention). We analyse the time limits and the compensation limits to make a claim or to defend you, depending on your position.
Transport penalties and driver employment law
The sector lives with a heavy penalty burden: tachograph, driving and rest times, excess weight, vehicle or goods documentation. Not all penalties are well founded. We review the proposal and, where appropriate, file representations and appeals against penalties within the time limit.
