What are grants?

First of all, let us define what is meant by a grant. We find that it is one of the promotional techniques or mechanisms available to public administration, whereby financial support from the public sector is transferred or awarded to a person, institution or private body so that they carry out a particular activity. One of its most notable features is that this outlay does not require the beneficiary to make any repayment on account of the grant.

Another element is that the activity to which the State allocates the grant must be regarded as being in the public interest, since these grants are set up with certain objectives such as, for example, supporting the launch of some businesses or preventing the closure of others.

In short, it is a way in which the State intervenes in the economy with the aim of keeping it stable and generating jobs.

Types of grants in Santander

Now that we have a somewhat clearer picture, it is worth noting that there are various types of grants. Under this arrangement, the process begins with a public call, which sets out the terms and provisions governing the award of the grant. These terms must be published in the Official State Gazette (Boletín Oficial del Estado) and, where applicable, in the Official Gazettes of the Autonomous Communities.

The documents intended for the award procedure may be submitted as originals or certified copies. In any event, each call establishes its own operating requirements.

THE RESULTS

The results of grant award procedures that have begun through a public call must be published in the Official State Gazette (Boletín Oficial del Estado), and in the Official Gazette of the Autonomous Community, within 30 days following the decision, without this preventing their notification to the interested parties.

Decisions in grant award procedures bring an end to administrative proceedings, which means that they can no longer be appealed before the Administration itself; instead, the courts must be approached. This may occur when there is some disagreement with the decision and the aim is to have it amended.

The beneficiary is required to justify that the support has been used for the purpose for which it was awarded and to comply with the conditions imposed. If they fail to do so, or do so incompletely or out of time, the Administration may start a recovery procedure and demand the full or partial repayment of the grant plus late-payment interest, and may even impose penalties.
